A ruling by a US appeals court has again thrown into question the future of the Deferred Action for Childhood Arrivals (DACA) program, which prevents the deportation of hundreds of thousands of immigrants brought into the United States as children. The fifth US circuit court of appeals decided that a federal district judge in Texas who last year declared DACA illegal, should take another look at the program, following revisions the Biden administration adopted in August.

The recent court ruling provides some relief for DACA recipients but still leaves their future uncertain. Now advocates for Dreamers and pushing the Senate to act during the lame-duck session on a previously passed bill, the Dream and Promise Act, which would create a path to citizenship. As of June 30, 594,120 immigrants who were brought to the U.S. as children were enrolled in DACA, half of whom live in California, Texas, and Illinois, according to data published by the U.S. Citizenship and Immigration Services (USCIS).

Lawmakers are calling for Congress to renew the Enhanced Child Tax Credit for 2023 during the upcoming lame-duck session. The child tax credit was temporarily expanded through the American Rescue Plan Act in 2021. The existing credit of $2,000 per child under age 17 was increased to $3,600 per child under 6 and $3,000 per child ages 6 through 17.

Half of the enhanced sum was made available through monthly payments starting last July — up to $300 per child under 6 and up to $250 per child under 18.  Families could claim the remaining money when they filed their tax returns for the year. It ended in December 2021.
